Innings Festival Giveaway - February 2025

Eligibility
This Innings Festival Giveaway (the “Giveaway”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia, who are at least 18 years of age at the time of entry.
Void outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
Sponsor and Sponsor’s respective affiliates, subsidiaries, successors, assigns, partners, agents, representatives, officers, directors, shareholders, advertising and promotion agencies, suppliers, and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Giveaway, including, without limitation, household members and the immediate family members of such individuals (collectively, “Sponsor” or “Indemnitees”), are not eligible to participate or win a prize. “Household members” shall mean those people who share the same residence at least three months a year. “Immediate family members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.
Sponsorship
The Giveaway Sponsor is C3 Presents located in Austin, TX. Sponsor will conduct the Giveaway substantially as described in these Official Rules. Sponsor is responsible for the collection, submission or processing of entries and the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Giveaway. Sponsor may be reached by email at dsudderth@c3presents.com during the Entry Period.
Entry Period
Entries will be accepted online starting on February 3rd, 2025 at 12 PM MST and ending February 8th, 12 AM MST. All online entries must be received by February 7th, 2024 11:59 PM MST.

Limitations on Entries
There are no limitations on the number of qualified entries.
Prize
The winner(s) of the Giveaway (the “Winner(s)”) will receive two 2-day Platinum VIP tickets to weekend one of Innings Festival, approximate value is $3810.) Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the sponsor.
The prize(s) has/have been donated by Sponsor’s partner in the Giveaway: Innings Festival/ C3 Presents. Sponsorship by the Arizona Office of Tourism in the Giveaway is not an endorsement of any specific commercial products, process, service, manufacturer, company, or trademark, nor discrimination against similar products or services not mentioned. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items.
Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. No other substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. A Form 1099-MISC will be issued to a Winner of a prize valued over $600, in which case Winner must provide Sponsor(s) with a valid Social Security number or tax identification number before prize will be awarded. Acceptance of prize constitutes permission for Sponsor(s) to use Winner's social media handle or name and entry for purposes of advertising and trade without further compensation unless prohibited by law.
Drawing
1 Winner will be selected by a random drawing under the supervision of Woobox. The Winner will be notified by Instagram direct message within 1 day following selection of the Winner. Sponsor shall have no liability for Winner's failure to receive notices due to spam, junk email, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 24 hours from the time award notification was sent, or fails to timely return required documentation requested by Sponsor, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN WINNER'S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Odds
The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Giveaway.
Warning
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should a virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions. Sponsor has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
General Terms
Sponsor will not be responsible for any injury, damage or loss or any kind arising out of your participation in the Giveaway. YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS SPONSOR AND INDEMNITEES, AS DEFINED HEREIN, FROM ANY OR ALL CLAIMS, LOSSES, INJURIES, OR DAMAGES RESULTING FROM (a) YOUR PARTICIPATION IN THE GIVEAWAY AND YOUR ACCEPTANCE, POSSESSION, USE,OR MISUSE OF ANY PRIZE OR PORTION THEREOF; (b) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE MALFUNCTION OF ANY COMPUTER, CABLE, NETWORK, HARDWARE, OR SOFTWARE, OR OTHER MECHANICAL EQUIPMENT; (c) THE UNAVAILABILITY, INACCESSIBILITY OR MISDELIVERY OF ANY TRANSMISSIONS, TELEPHONE, OR INTERNET SERVICE OR MESSAGES; (d) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE GIVEAWAY; (e) ELECTRONIC OR HUMAN ERROR IN THE ADMINISTRATION OF THE GIVEAWAY OR THE PROCESSING OF ENTRIES; OR (f) ANY INJURY OR DAMAGE TO PARTICIPANT'S OR TO ANY OTHER PERSON’S COMPUTER OR MOBILE DEVICE WHICH MAY BE RELATED TO OR RESULTING FROM ANY ATTEMPT TO PARTICIPATE IN THE GIVEAWAY OR DOWNLOAD OF ANY MATERIALS IN THE GIVEAWAY.
Disputes
THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF ARIZONA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees to resolve any disputes through arbitration, after exhausting applicable administrative review, to the extent required by Arizona Revised Statutes § 12-1518, except as may be required by other applicable statutes; and that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Maricopa County, Arizona having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). Participant further waives all rights to have damages multiplied or increased.
Winner’s Name

The Giveaway is in no way sponsored, endorsed, administered by, or associated with the social media platform where it is posted or advertised. A social media account may be required to enter. It is free to create an account. You understand that you are providing your information to the Sponsor and not to the social media platform. Privacy
Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at www.c3presents.com. By entering the Giveaway, you grant Sponsor permission to share your email address and any other personally identifiable information with the other Giveaway partners or affiliated entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.
Acceptance of Terms
By entering the Giveaway, You, the entrant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
